1) Revocation; 2) Effective March 12, 1996. Respondent was appointed to serve as the guardian ad litem for a protected person's estate. The conservator of that estate erroneously made an overpayment of guardian ad litem fees in the amount of $350. The panel found, by default, that respondent failed and/or refused to comply with the conservator's requests for return of the $350 overpayment; improperly retained the overpayment although he lacked court authority or permission from the estate to do so; failed to answer the Request for Investigation; and failed to answer the Formal Complaint. Respondent also failed to appear at the disciplinary hearing.
Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A)and(B)(2); and Michigan Rules of Professional Conduct 1.15(b); 8.1(b); and 8.4(a)and(c).
Costs were assessed in the amount of $170.31. NOTE: Respondent has been suspended from the practice of law in Michigan continuously since July 22, 1994.
