NOTICE OF REPRIMAND (By Consent)

Case No. 95-215-GA Horace E. Stone, P-21056, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #26.

1) Reprimand; 2) Effective February 9, 1996. Respondent was appointed successor temporary personal representative of an estate in an ancillary proceeding in Wayne County Probate Court. He pled nolo contendere to allegations that he failed to file annual accountings; failed to comply with a court order removing him as the fiduciary which required that he file an accounting and turn over all documents and property of the estate; and failed to file an accounting or return the property of the estate until after an order to show cause was entered against him, a hearing held, and a further order entered to compel his compliance. Respondent's conduct was alleged to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.15(b); 3.2; 3.4(c); and 8.4(a)and(c).

The parties stipulated that respondent be reprimanded. Costs were assessed in the amount of $54.46.
