NOTICE OF SUSPENSION AND RESTITUTION (By Consent)

Case No. 95-204-GA Cynthia D. Wilson, P-39511, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #15.

1) Suspension - seven (7) months; 2) Effective January 10, 1996. Respondent was retained to represent four separate clients in bankruptcy matters. She admitted that she neglected the matters and failed to return the unearned fees.

Respondent was retained to represent a woman in a personal injury matter. She admitted that she neglected the matter and failed to file a timely answer to the Request for Investigation.

Respondent represented a man in criminal and divorce matters. She was paid a $250 attorney fee and a $250 polygraph fee. She admitted that she failed to deposit the polygraph fee in a trust account; deposited the polygraph fee into her general account, commingling the funds; failed to pay the funds to the polygraph examiner or return the money to her client; and knowingly issued a check to the polygraph examiner drawn on a closed account.

Respondent's conduct was admitted to be in violation of MCR 9.104(1)-(4)and(7); MCR 9.103(C); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 1.5(a); 1.15(a)- (c); 1.16(d); 3.2; and 8.4(a)-(c).

The parties stipulated that respondent be suspended for seven months and make restitution to three of the complainants in the total amount of $2,750. Costs were assessed in the amount of $416.02.

NOTE: Respondent has been suspended from the practice of law in Michigan continuously since August 20, 1994.
