1) Suspension - One (1) Year; 2) Effective January 10, 1996. Respondent was retained to represent the complainant in bankruptcy proceedings. Respondent stipulated that she neglected the matter; failed to refund the unearned $500 attorney fee; and failed to refund the unused $150 filing fee.
Respondent was suspended from the practice of law in Michigan for 180 days effective August 20, 1994 in Case No. 93- 280-GA; for six months effective November 22, 1994 in Case No. 94-215-GA; and for seven months effective January 10, 1996 in Case No. 95-204-GA. Respondent has not been reinstated to the practice of law and has been continuously suspended since August 20, 1994. The complainant was an active client of respondent as of August 20, 1994. Respondent stipulated that she failed to give the notice required by MCR 9.119(A) and the orders of suspension.
Respondent's conduct was found to be in violation of MCR 9.104(1)-(4) and (9); MCR 9.119(A); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4; 1.5(a); 1.15(a) and (b); 1.16(a) and (d); 3.2; and 8.4(a) and (c).
The panel ordered that respondent be suspended from the practice of law in Michigan for one year retroactive to January 10, 1996, to run concurrently with the Order of Suspension and Restitution (By Consent) entered in Case No. 95-204-GA. The panel further ordered that respondent make restitution to the complainant in the amount of $650. Costs were assessed in the amount of $323.69.
