NOTICE OF REPRIMAND WITH CONDITION Case No. 93-205-GA Barry D. Yaker, P-22605, Birmingham, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #68.

1) Reprimand; 2) Effective January 31, 1996. Respondent represented the potential sellers in a real estate transaction. Regarding a $50,000 check respondent received for a deposit in connection with that transaction, he pled no contest to allegations that he violated Michigan Rule of Professional Conduct 1.15(a): "A lawyer shall hold property of clients or third persons that is in the lawyer's possession in connection with a representation separate from the lawyer's own property . . ."

The panel ordered that respondent be reprimanded conditioned upon his filing of a certification by a certified public accountant that his client trust account meets all of the requirements of the Michigan Rules of Professional Conduct. Costs were assessed in the amount of $1,954.65.
