NOTICE OF REPRIMAND AND PROBATION (By Consent)
Case No. 95-176-GA Linda M. Baxter, P-30281, Utica, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #106.
1) Reprimand and Probation one (1) year; 2) Effective December 13, 1995. Respondent was retained to prepare various trusts, wills, powers of attorney and estate plans for eight separate clients, consisting of three married couples and five individuals. She admitted that she failed to prepare proper and consistent documents and estate plans based on her clients' financial circumstances, intentions, needs and objectives, in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(a)-(c) and 8.4(a)and(c).
The parties stipulated that respondent be reprimanded and placed on probation for one year, subject to conditions including continuing legal education in estate planning and/or probate, and restitution to six of the complainants in the total amount of $7,750. Costs were assessed in the amount of $88.56.
