NOTICE OF SUSPENSION Case No. 92-208-GA Edward Brady Denton, Jr., P-12687, Saginaw, Michigan, by the Attorney Discipline Board affirming Genesee County Hearing Panel #1's Order of Suspension.

1) Suspension - forty-five (45) days; 2) Effective November 11, 1995. Midland County Hearing Panel #1 dismissed the forty-count Formal Complaint in January 1993. The Grievance Administrator filed a petition for review. On review, the Attorney Discipline Board found that there was ample evidentiary support in the record for thirty-one of those counts, which alleged that the respondent accepted new retainers or engagements after entry of the order of suspension in Case No. 90-117-JC and that the respondent engaged in the practice of law during the period of that suspension, April 17, 1991 to September 9, 1991. The Board vacated the order of dismissal and remanded the matter to another panel, Genesee County Hearing Panel #1, to determine the appropriate discipline. On September 30, 1994, Genesee County Hearing Panel #1 ordered that respondent be suspended from the practice of law in Michigan for forty-five days. Respondent's conduct was found to be in violation of MCR 9.104(1)-(4)and(8); MCR 9.119; MCL 600.916; MSA 27A.916; and Michigan Rules of Professional Conduct 3.3(a) and 8.4(a)-(c).

The respondent and the Grievance Administrator each filed a petition for review. On December 19, 1994, the Attorney Discipline Board affirmed the forty-five day suspension. Respondent filed a motion for reconsideration, which was denied by the Board on January 13, 1995. Respondent filed an application for leave to appeal, which was denied by the Michigan Supreme Court on August 28, 1995. Respondent filed a motion to change the effective date of the suspension, which was granted by the Board. The suspension is deemed to be effective November 11, 1995. Costs were assessed in the amount of $899.59.
