NOTICE OF SUSPENSION (By Consent)

Case No. 95-158-GA Harry J. Creager, P-12331, Benton Harbor, Michigan, by Attorney Discipline Board Berrien County Hearing Panel.

1) Suspension - three (3) years; 2) Effective November 28, 1995. Respondent's long-term relationship with a law firm terminated with the signing of a dissolution agreement. He pled no contest to allegations that approximately nine months later, after consuming several alcoholic beverages, he used his rifle to shoot out two windows at his former law firm's office, in violation of MCR 9.104(1)-(4) and Michigan Rules of Professional Conduct 8.4(a)-(c).

Respondent was retained to recover damages for personal injuries his client sustained in an automobile accident, and filed suit on his client's behalf. He pled no contest to allegations that he neglected the matter, in violation of MCR 9.104; and Michigan Rules of Professional Conduct 1.1(a)-(c); 1.2(a); 1.3; 1.4; 3.2; and 8.4(a)and(c).

The parties stipulated that respondent be suspended from the practice of law in Michigan for three years. Costs were assessed in the amount of $97.20.
