NOTICE OF SUSPENSION Case No. 93-191-GA Peter E. O'Rourke, P-18528, Detroit, Michigan, by the Attorney Discipline Board increasing a hearing panel order of reprimand.

1) Suspension - 180 days; 2) Effective November 1, 1995. The formal complaint charged that in August 1992, while in a locker room at the Grosse Pointe Yacht Club, the respondent engaged in illegal and improper physical contact with a young man, then age fifteen. Tri-County Hearing Panel #25 concluded that the respondent's conduct violated MCR 9.104(3) which proscribes conduct contrary to "justice, ethics, honesty, or good morals." (emphasis added). Following the separate hearing on discipline, the panel entered an order of reprimand.

The Attorney Discipline Board considered separate petitions for review filed by the Grievance Administrator and the respondent. In an order and opinion entered on July 18, 1995, the Board concluded that the panel's findings and conclusions with regard to the nature of the respondent's misconduct should be affirmed. The Board further found that the facts and circumstances of this case warrant a suspension of the respondent's license to practice law for a period of 180 days. The respondent filed a motion for reconsideration, which was denied by the Board on October 10, 1995. The suspension is deemed to be effective November 1, 1995.

Costs were assessed in the total amount of $2,150.11.
