NOTICE OF SUSPENSION Case No. 94-126-GA Gregory D. Shulman, P-41459, Southfield, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #83.
1) Suspension - thirty (30) days; 2) Effective December 8, 1995. Respondent was retained to represent a client in a pending child custody matter. The panel found, by a preponderance of the evidence, that respondent neglected the matter; failed to refund the unearned $500 retainer fee upon request; and failed to answer the Request for Investigation.
Respondent conduct was found to be in violation MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A)and(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 1.15(b); 1.16(d); 3.2; 8.1(b); and 8.4(a)and(c).
On June 13, 1995, the panel entered an Order of Suspension for thirty days. Costs were assessed in the amount of $987.59.
Respondent filed a petition for review and automatic stay of discipline. On September 18, 1995, the Grievance Administrator filed a Motion to Strike Respondent's Brief in support of petition for review for his failure to serve the brief on the Administrator and his failure to file a proof of service. That motion was granted by the Attorney Discipline Board on October 6, 1995. On October 19, 1995, the Administrator filed a Motion to Dismiss respondent's petition for review. That motion was granted by the Board on November 16, 1995. The thirty-day suspension is deemed to be effective December 8, 1995.
