NOTICE OF DENIAL OF REINSTATEMENT Case No. 94-130-RP Bernard Adams, Jr., P-10033, Detroit, Michigan, by the Attorney Discipline Board vacating a hearing panel order granting petition for reinstatement.

1) Reinstatement Denied; 2) Effective November 1, 1995. The petitioner was suspended from the practice of law in Michigan for a period of 180 days effective August 10, 1993. His petition for reinstatement filed in accordance with MCR 9.123(B) and MCR 9.124 was granted by Tri-County Hearing Panel #7. The panel concluded, by majority, that the petitioner had satisfactorily established his eligibility for reinstatement in accordance with the guidelines of those court rules. The panel further ordered that the petitioner open a client trust account in compliance with IOLTA and practice under the supervision of another attorney for a period of one year.

The Grievance Administrator filed a petition for review seeking reversal of the order granting reinstatement. Respondent was reinstated (pending appeal) effective April 25, 1995. On October 10, 1995, the Attorney Discipline Board entered an order and opinion vacating the hearing panel order and denying the petition for reinstatement. The Board held that there was insufficient evidentiary support in the whole record to support the hearing panel majority conclusion that petitioner had established the criteria of MCR 9.123(B)(5),(6)and(7) by clear and convincing evidence. The Board's order became effective on November 1, 1995, and the petitioner is ineligible to practice law in Michigan as of that date.

Costs were assessed in the total amount of $1,249.58.
