NOTICE OF REPRIMAND WITH CONDITION Case No. 94-91-GA Jeffrey T. McCarty, P-42633, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #18.
1) Reprimand; 2) Effective October 6, 1995. Respondent was appointed to represent a woman in a claim for Social Security Widow's Benefits. The panel found that respondent sought to charge an illegal fee, in violation of MRPC 1.5(a); and, in a collection suit filed against his client, he failed inform the court that he had previously agreed that he would not charge or receive any fee unless authorized in accordance with the Social Security laws and regulations and, that by virtue of his acceptance of the appointment, federal law expressly limited his fee to that awarded by the Social Security Administration, in violation of MCR 9.104(1) and MRPC 8.4(a)and(c).
The panel ordered that respondent be reprimanded with the condition that he attend a seminar on one of the following subjects: federal practice, legal ethics, client relationships or office management. Costs were assessed in the amount of $1,005.03.
