NOTICE OF REPRIMAND AND RESTITUTION WITH CONDITION (By Consent)

Scott E. Pederson, P 33518, Grand Rapids, Michigan. by the Attorney Discipline Board Kent County Hearing Panel #4.

Reprimand. Effective March 27.2019.

Respondent and the Grievance Administrator filed a Stipulation for Consent Order of Discipline. in accordance with MCR 9.115(F)(5). which was approved by the Attorney Grievance Commission and accepted by the hearing panel.

Based upon respondent's admissions and the stipulation of the parties. the panel found that respondent committed acts of professional misconduct, including failing to promptly pay or deliver funds which a client is entitled to receive, during his handling of a matter titled People v Cordairo Aqtavian Lambert, Kent County Circuit Court, Case 16-1 0325-FH. Specifically. the panel found that respondent failed to keep disputed funds separate. in violation of MRPC 1.15(c); failed to hold client property separate from his own, in violation of MRPC 1.15(d); and upon termination of representation, failed to surrender property to which the client is entitled, in violation of MRPC 1.16{d). Respondent was also found to have violated MCR 9.104(2) and (3).

In accordance with the stipulation of the parties, the panel ordered that respondent be reprimanded, pay restitution totaling $300, and comply with a condition relevant to the established misconduct. Costs were assessed in the amount of $763.87.
