NOTICE OF REVOCATION AND RESTITUTION Case No. 95-122-GA Gregory K. Jackson, P-24638, Southfield, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #66.

1) Revocation; 2) Effective September 12, 1995. Respondent filed a motion to set aside default judgment on the defendant's behalf in a landlord/tenant action. The panel found, by default, that respondent's motion to set aside default was frivolous because it did not have any basis in law or in fact and was advanced for an improper purpose. The court found that respondent's motion to set aside default was frivolous and sanctioned him a $750.00 fine. Respondent failed to pay the $750.00 fine. Respondent was served with two separate subpoenas requiring him to appear for creditor's examinations in connection with the unpaid sanctions. The panel found, by default, that respondent failed to appear in compliance with the subpoenas, causing bench warrants to issue for his arrest. Respondent also failed to appear at the disciplinary hearing.

Respondent's conduct constitutes professional misconduct in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 3.1; 3.4(c); and 8.4(a)-(c).

The panel order that respondent's license to practice law be revoked and that he make restitution to the complainant in the amount of $750 plus interest. Costs were assessed in the amount of $194.96.

NOTE: In an unrelated matter, Case Nos. 95-49-GA; 95-79-FA, respondent's license to practice law in Michigan was revoked (pending appeal) effective August 17, 1995.
