NOTICE OF PROBATION (By Consent)

Case No. 95-164-GA Scott F. Bergo, P-25455, Livonia, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #34.

1) Probation - two (2) years; 2) Effective October 1, 1995. Respondent pled no contest to allegations that he violated a criminal law which resulted in a misdemeanor conviction: Operating a Motor Vehicle While Under the Influence of Intoxicating Liquor/ Operating While Having an Unlawful Blood Alcohol Level, 53rd District Court, Brighton, Michigan, contrary to MCL 257.625(1); MSA 9.2325. Respondent's conduct was alleged to be in violation of MCR 9.104(1)-(5) and the Michigan Rules of Professional Conduct, 8.4(a)-(c).

In October 1995, the parties executed and filed a Stipulation for Consent Order of Discipline. A hearing regarding that stipulation was held on March 12, 1996. On May 17, 1996, the panel entered an Order of Probation (By Consent), placing respondent on probation for two years effective October 1, 1995. Costs were assessed in the amount of $193.00.
