NOTICE OF SUSPENSION Case Nos. 95-177-GA; 95-196-FA Case No. 95-194-GA

Martin B. Marcus, P-34234, Oak Park, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #79.

1) Suspension - one (1) year; 2) Effective October 13, 1995. Respondent was retained and paid $2,500 to represent a defendant on charges of inciting or procuring perjury and obstruction of justice, as well as an assault charge in a companion case. The panel found, by default, that respondent neglected the matter and failed to answer the Request for Investigation. The panel also found, by default, that respondent failed to answer a separate, unrelated Request for Investigation and failed to answer three Formal Complaints. Respondent also failed to appear at the disciplinary hearing.

Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4); MCR 9.113(A)and(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 1.16(d); 3.2; 3.4(c); 8.1(b) and 8.4(a)and(c).

On October 13, 1995, the panel entered an Interim Order of Suspension effective on the date of entry. On December 4, 1995, the panel entered an Order of Suspension for one year effective October 13, 1995, the effective date of the interim suspension. Costs were assessed in the amount of $210.96.
