NOTICE OF SUSPENSION (By Consent)

Case No. 94-222-GA Herbert H. Schebor, P-23988, Garden City, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #1.

1) Suspension - thirty (30) days; 2) Effective July 29, 1995. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission.

Respondent was the personal representative and attorney for an estate in Wayne County Probate Court. He pled no contest to allegations that he failed to file accountings on behalf of the estate; failed to comply with a probate court order; failed to file tax returns on behalf of the estate; failed to timely administer and close the estate; and failed to keep the heirs reasonably informed concerning the status of the estate.

Respondent's conduct was alleged to be in violation of MCR 9.104(1)-(4) and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 3.2; 3.4(c); and 8.4(a)and(c).

The parties stipulated that respondent be suspended from the practice of law for thirty days and until he files the accounting covering the period of his administration for the estate. Costs were assessed in the amount of $212.74.
