NOTICE OF REPRIMAND (By Consent)
Case No. 94-89-GA Peter J. Betrus, P-10769, Monroe, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #30.
1) Reprimand; 2) Effective August 10, 1995. Respondent was retained in to represent a married couple and their children in personal injury litigation resulting from a collision between a train and a pick-up truck. He pled no contest to allegations that he undertook the representation of the husband, the driver of the truck involved in the accident, while at the same time representing the wife and children who were passengers in the truck at the time of the accident; and failed to withdraw from the representation after the conflict of interest became apparent, approximately ten years after he was retained.
Respondent's conduct was alleged to be in violation of MCR 9.104(1)-(4); Michigan Rules of Professional Conduct 1.6(b)(2); 1.7; 1.8(a)and(b); 1.9; and 8.4(a)and(c); and Canons 1, 2 and 5 of the then-applicable Code of Professional Responsibility, DR 1- 102(A)(1),(5)and(6); DR 2-110-(B)(2); and DR 5-105(A)and(B).
Costs were assessed in the amount of $742.60.
