1) Probation; 2) Effective September 14, 1995 through November 16, 1996. Respondent was retained in three separate unrelated matters, one divorce, one corporate and one personal injury, and received retainer fees in various amounts for each matter. He admitted that he failed to deposit the unearned portion of the fees into a client trust account and commingled the unearned portion of the fees, in violation of MCR 9.104(1)-(4), MRPC 1.15 and MRPC 8.4(a)and(c); and failed to file timely answers to the Requests for Investigation, in violation of MCR 9.103(C), MCR 9.104(1)-(4)and(7), MCR 9.113(A)and (B)(2), MRPC 8.1(b) and MRPC 8.4(a)and(c).
Respondent admitted that he purchased crack cocaine and possessed a soda pop bottle which had been specifically altered for use as a crack cocaine pipe, in violation of MCR 9.104(1)-(5) and MRPC 8.4(a)-(c).
The panel ordered that respondent be placed on probation from September 14, 1995 through November 16, 1996. Costs were assessed in the amount of $998.03.
