1) Revocation; 2) Effective August 1, 1995. Respondent was retained by a woman to pursue modification of a divorce judgment and to conduct a discovery hearing concerning her ex-husband's assets, and was paid a $250 retainer fee. The panel found, by default, that respondent failed to take action to modify the divorce judgment; failed to conduct a discovery hearing; failed to keep in communication with his client; failed to respond to his client's request for a refund of the retainer fee; failed to respond to his client's request for her file, or that of her subsequent counsel; failed to answer the Request for Investigation; and failed to answer the Formal Complaints. Respondent also failed to appear at the disciplinary hearing.
Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A)and(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 1.5(a); 1.15(c); 1.16(d); 3.2; 8.1(b); and 8.4(a)and(c).
The panel ordered that respondent's license to practice law be revoked and that he make restitution to the complainant in the amount of $275. Costs were assessed in the amount of $261.50.
NOTE: Respondent has been disqualified from the practice of law in Michigan since March 11, 1994.
