NOTICE OF REPRIMAND AND RESTITUTION Case No. 95-29-GA Mark L. Bellamy, P-39715, Tallahassee, Florida (formerly of Oakland County, Michigan), by Attorney Discipline Board Tri-County Hearing Panel #66.
1) Reprimand; 2) Effective July 1, 1995. Respondent was retained in connection with a landlord/tenant matter. He collected garnishment proceeds for his client and deposited the proceeds in his client trust account. The panel found that respondent failed to maintain the funds in trust for his client; failed to provide his client with an accounting of the monies collected; issued a check out of his IOLTA trust account to his client for $433, which was returned marked "non-sufficient funds"; and failed to make prompt, full restitution to his client upon demand.
Respondent's conduct was found to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.15(a)- (c) and 8.4(a)-(c).
The panel ordered that respondent be reprimanded and make restitution to his client in the amount of $545. Costs were assessed in the amount of $322.55.
