NOTICE OF REPRIMAND AND RESTITUTION (By Consent)
Case No. 95-34-GA Frederick J. Blackmond, P-29696, Lansing, Michigan, by Attorney Discipline Board Ingham County Hearing Panel #2.
1) Reprimand; 2) Effective July 27, 1995. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission.
Respondent was retained to seek further appellate relief on behalf of the defendant in a criminal matter. Respondent pled no contest to allegations that he failed to timely file an application for leave to appeal; improperly filed a claim of appeal as of right from a motion for relief from judgment; and failed to take timely action to file an application for leave to appeal after the court dismissed the claim of appeal.
Respondent's conduct was alleged to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(a)and(c); 1.3; 3.2; and 8.4(a)and(c).
Respondent agreed to make restitution to the complainant in the amount of $5,000. Costs were assessed in the amount of $66.98.
