1) Revocation; 2) Effective May 5, 1995. Respondent failed to answer the Formal Complaint and failed to appear at the hearing held in Detroit on February 23, 1995. Respondent's default was entered, and the panel determined that the default established the allegations of the Formal Complaint.
Respondent was appointed special conservator for an estate by the Eaton County Probate Court. The panel found, by default, that he failed to timely file an inventory on the estate's behalf; failed to timely file accountings on the estate's behalf; failed to comply with a court order, causing him to be removed as special conservator; misappropriated approximately $25,000 in estate funds; and commingled his personal funds with client funds.
Respondent's conduct was found to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.15(a)and(b); 3.2; and 8.4(a)-(c).
Costs were assessed in the amount of $118.00.
