AMENDED NOTICE OF REPRIMAND (By Consent)
Case No. 91-181-GA William E. Peters, P-18828, Bay City, Michigan, by the Attorney Discipline Board affirming a hearing panel order of reprimand (by consent).
1) Reprimand; 2) Effective April 1, 1995. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission.
Respondent was appointed the guardian and conservator of a legally incapacitated person. As fiduciary, the respondent sold certain real property belonging to the estate. The respondent offered his plea of nolo contendere to the allegations in the complaint that his conduct created an appearance of a conflict of interest.
The complainant filed a petition for review. Following review proceedings, the Attorney Discipline Board remanded the matter to the hearing panel for clarification. Following remand proceedings, the panel issued a supplemental report. On March 10, 1995, the Board issued an order affirming consent order of remand.
Costs were assessed in the amount of $441.98
