1) Suspension - 180 days; 2) Effective March 21, 1995. Respondent was retained to represent the defendant in a criminal appeal matter and was paid $3,200 toward the representation. The hearing panel found, by a preponderance of the evidence, that respondent failed to deposit the $3,200 into a trust account; deposited the monies into his personal account prior to the actual performance of the work, commingling client funds with his own; failed to return $2,500 in unearned fees until after the complainant filed a Request for Investigation; and failed to answer three Requests for Investigation.
Respondent's conduct was found to be in violation MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A)and(B)(2); and Michigan Rules of Professional Conduct 1.15(a)-(c); 1.16(d); 8.1(b); and 8.4(a)-(c).
Costs were assessed in the amount of $772.94. NOTE: Respondent has been suspended from the practice of law in Michigan continuously since July 6, 1994.
