1) Reprimand; 2) Effective March 31, 1995. After respondent was terminated from his employment with a law firm, he came into possession of a number of settlement checks, in the total amount of $200,000, for cases he had handled on behalf of the firm. After the deduction of the amounts owed to the clients and the costs and attorney fees owed to respondent, the firm was entitled to $35,435.81 for costs and attorney fees.
The hearing panel found, by a preponderance of the evidence, that respondent failed to deposit and maintain the funds in a trust account pending the resolution of any perceived dispute, in violation of Michigan Rules of Professional Conduct 1.15(c) and 8.4(a).
Costs were assessed in the amount of $985.97.
