NOTICE OF REPRIMAND (By Consent)

Case No. 94-210-GA Robert E. Reed, P-30591, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #14.

1) Reprimand; 2) Effective March 2, 1995. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission.

Respondent was retained and paid $1,600 to represent a couple in a bankruptcy action which was necessary to forestall a sheriff's sale of their home pursuant to the foreclosure of their construction mortgage. He pled no contest to allegations that he failed to file necessary plans and schedules in the bankruptcy matter, despite having been granted an extension of time in which to do so, resulting in the dismissal of the bankruptcy; failed to refile the bankruptcy matter, resulting in his clients home being sold at a sheriff's sale; and failed to keep in reasonable communication with his clients.

Respondent's conduct was alleged to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(a)- (c); 1.2(a); 1.3; 1.4; 3.2; and 8.4(a)and(c).

Costs were assessed in the amount of $68.75.
