NOTICE OF SUSPENSION (By Consent)

Case No. 94-97-GA Alvin D. Fick, Jr., P-37151, Dearborn, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #32.

1) Suspension - sixty (60) days; 2) Effective March 18, 1995. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission.

Respondent was retained to institute and handle a probate estate. Respondent admitted that he failed to timely file an inventory; failed to timely file an accounting; failed to assist the personal representative in preparing and filed the appropriate inventories and annual accounts; failed to file final accounts in a timely manner; and failed to advise the personal representative of the status of the matter or to answer the inquiries of the personal representative in this regard.

Respondent was retained to institute and assist the personal representative in another estate. He admitted that he failed to file the inventories in a timely manner; failed to file annual accounts in a timely manner; and failed to properly file the forms necessary to assessment of Michigan inheritance tax.

Respondent's conduct was admitted to be in violation of MCR 9.104(1)-(4); Canons 1, 6 and 7 of the then-applicable Code of Professional Responsibility, DR 1-102(A)(1),(5)and(6); DR 6-101(A) (3); and DR 7-101(A)(1)-(3); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 3.2; and 8.4(a)and(c).

Costs were assessed in the amount of $253.35.
