NOTICE OF REVOCATION AND RESTITUTION Case No. 94-152-GA Kenneth N. Graham, P-44333, Grosse Pointe Farms, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #106.

1) Revocation; 2) Effective March 30, 1995. Respondent was retained to represent seven clients in a variety of matters, including driver's license restorations, sentence reduction, collection actions, a divorce action, expungement of a criminal record, and carrying a concealed weapon. The panel found, by a preponderance of the evidence, that respondent neglected the matters; failed to respond to his clients' inquiries; failed to keep his clients reasonably informed; knowingly made false statements to his clients; failed to refund unearned fees; failed to release a client's file upon request; misappropriated client funds; engaged in an improper loan transaction with a client; gave a client a check which was dishonored for insufficient funds; failed to appear for a hearing on an order to show cause, causing a warrant to be issued for his arrest; failed to report weekly to the court pursuant to the court's order; failed to answer the Requests for Investigation; and failed to appear at the disciplinary hearing.

Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 1.8(a); 1.15(a)and(b); 1.16(d); 3.2; 3.4(c); 3.5(c); 8.1(b); and 8.4(a)-(c).

The panel ordered that respondent's license to practice law in Michigan be revoked, and that he make restitution to the seven complainants in the total amount of $9,550.00 plus interest. Costs were assessed in the amount of $448.93.
