NOTICE OF REPRIMAND Case No. 94-115-GA David L. Underwood, P-44754, Lansing, Michigan, by Attorney Discipline Board Ingham County Hearing Panel #2.
1) Reprimand; 2) Effective February 16, 1995. Respondent was paid a $500 retainer to institute proceedings to remove a court ordered lien for a future support obligation to his client's former spouse which had been entered against his client's retirement account. The panel found that respondent failed for over seven months to file a motion to set aside the order for lien; failed to properly notice that motion for hearing; failed to keep in reasonable communication with his client or to respond to his inquiries; and failed to answer the Request for Investigation.
Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A)and(B)(2); and Michigan Rules of Professional Conduct 1.1(b)and(c); 1.3; 1.4(a); 3.2; 8.1(b); and 8.4(a).
Costs were assessed in the amount of $901.27.
