NOTICE OF REVOCATION AND RESTITUTION Case No. 94-59-GA Dennis W. Koltunchik, P-36255, Plymouth, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #33.
1) Revocation; 2) Effective January 18, 1995. The panel found that the allegations of professional misconduct contained in thirteen of the twenty-one counts of the Formal Complaint were established by a preponderance of the evidence. The panel found that respondent committed multiple acts of: client neglect; failure to communicate with clients and opposing counsel; failure to comply with prior order of suspension; failure to refund unearned fees; and failure to cooperate with Attorney Grievance Commission subpoenas.
Respondent's conduct was found to be in violation of MCR 9.104(1)-(4); MCR 9.119(A)and(B); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4(a); 1.16(d); 3.2; 8.1(b) and 8.4(a)-(c).
The panel ordered that respondent's license to practice law in Michigan be revoked and that he make restitution to three of the complainants in the total amount of $1,300. Costs were assessed in the amount of $1,488.65.
NOTE: Respondent has been suspended from the practice of law in Michigan continuously since July 1, 1993.
