NOTICE OF REPRIMAND (By Consent)
Case No. 94-123-GA Robert L. Harley, Jr., P-30166, Comstock Park, Michigan, by Attorney Discipline Board Kent County Hearing Panel #3.
1) Reprimand; 2) Effective March 2, 1995. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission.
Respondent was paid a $500 retainer to render a legal opinion to a condominium association concerning real estate issues and to file a lien on behalf of the association. He pled no contest to allegations that he failed to render a legal opinion on behalf of the association; failed to file a lien on behalf of the association; failed to keep his client advised of his changes in address and telephone number; failed to refund the unearned fees upon demand; failed to promptly turn over the client file after his discharge; and failed to keep in reasonable communication with his client.
Respondent's conduct was alleged to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(a)- (c); 1.2(a); 1.3; 1.4; 1.15(b); 1.16(d); and 8.4(a)and(c).
Costs were assessed in the amount of $42.75.
