1) Reprimand; 2) Probation - two years; 3) Both effective January 18, 1995. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission.
Respondent was appointed to represent a defendant in post- guilty plea proceedings in the Recorder's Court and the Court of Appeals. She pled no contest to allegations that she failed to take any action on her client's behalf in the trial court or the Court of Appeals; failed to respond to her client's inquiries regarding the matter or to advise him of her inaction on his behalf; and failed to withdraw from the matter although her continued representation was materially impaired by a physical or mental condition that prevented her ability to represent her client in the manner required by the Rules of Professional Conduct.
Respondent's conduct was alleged to be in violation of MCR 9.104(1)-(4) and Michigan Rules of Professional Conduct 1.1(a)and(c); 1.3; 1.4(a); 1.16(a)(1)and(2); 3.2; and 8.4(a)and(c).
Costs were assessed in the amount of $63.00.
