NOTICE OF SUSPENSION WITH CONDITIONS Case Nos. 92-288-GA; 92-318-FA Patrick J. O'Mara, P-37529, Blissfield, Michigan and Moscow, Russia, by the Attorney Discipline Board increasing a hearing panel order of reprimand.

1) Suspension - thirty (30) days; 2) Effective January 10, 1995. Attorney Discipline Board Washtenaw County Hearing Panel #1 found that the allegations of professional misconduct contained in Formal Complaint 92-318-FA were established by a preponderance of the evidence, to wit: Respondent failed to answer Formal Complaint 92-288-GA, in violation of MCR 9.104(1),(2),(4)and(7) and Michigan Rules of Professional Conduct 8.1(b) and 8.4(a)and(c). The allegations of professional misconduct contained in Formal Complaint 92-288-GA were dismissed.

The complainant filed a petition for review seeking reversal of the dismissal of Formal Complaint 92-288-GA. On review, the Board affirmed the dismissal of that complaint, but increased the discipline imposed for the established misconduct in Formal Complaint 92-318-FA to a suspension of thirty days. The Board further ordered that respondent's eligibility to file an affidavit for automatic reinstatement pursuant to MCR 9.123(A) is conditioned upon his filing of written proof that he has satisfactorily completed a minimum of thirty hours of continuing legal education on the subjects of professional ethics and/or professional responsibility. Respondent filed a motion for reconsideration, which was denied by the Board in an order issued February 22, 1995.

Costs were assessed in the amount of $1,384.17.
