NOTICE OF SUSPENSION AND PROBATION WITH RESTITUTION Case Nos. 94-40-GA; 94-67-FA Leonard M. Mazor, P-31020, Southfield, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #75.

1) Suspension - 182 days; 2) Effective November 3, 1994. 3) Probation - two years; 4) Effective upon reinstatement. Respondent failed to answer the Formal Complaints but appeared at the hearing held in Bloomfield Hills on June 7, 1994. Respondent's defaults were entered, and the panel determined that the defaults established the allegations of the Formal Complaints.

Respondent was retained to represent a defendant on a charge of assault and battery and for the subsequent appeal, but failed to adequately prepare for trial; failed to file an appellate brief; failed to inform his client of his failure to file the brief or to timely inform him of the dismissal of the appeal; knowingly made false statements to his client; and knowingly made a false representation in his answer to the Request for Investigation.

Respondent was retained to represent the defendant in a civil matter, but although he informed the court of his intention to withdraw from the representation, failed to file a motion to withdraw; failed to inform his client of his intention to withdraw; failed to respond to numerous inquiries from his client; failed to appear on his client's behalf at trial; failed to inform the court, opposing counsel or his client of his intention not to appear for trial; knowingly made a false representation in his answer to the Request for Investigation; and, without his client's knowledge or consent, entered into a settlement and executed a consent judgment.

Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4),(6)and(7); MCR 9.113(A); and the Michigan Rules of Professional Conduct, 1.1(b)and(c); 1.3; 1.4; 1.16(d); 3.2; 4.1; 8.1(a)and(b); and 8.4(a)-(c).

The panel ordered that respondent be suspended for 182 days, be placed on probation for two years upon his reinstatement, and make restitution to one complainant in the amount of $100.00. Costs were assessed in the amount of $358.34.
