NOTICE OF SUSPENSION Case No. 94-6-GA Marvin L. Berris, P-10751, Southfield and Franklin, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #63.
1) Suspension - ninety (90) days; 2) Effective January 1, 1995. Respondent was retained to represent the plaintiff in a pending malpractice action. The panel found, by a preponderance of the evidence, that respondent neglected the matter and, after being discharged, failed to timely surrender papers and property belonging to the client.
Respondent admitted that he failed to answer four Requests for Investigation.
Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A)and(B)(2); and Michigan Rules of Professional Conduct 1.1; 1.3; 1.4; 1.15(b); 1.16(d); 3.2; 8.1(b); and 8.4(a)and(c).
Costs were assessed in the amount of $1,704.67.
