NOTICE OF SUSPENSION Case Nos. 93-190-GA; 93-209-FA Philip L. Dulmage, P-13009, Flint, Michigan, by Attorney Discipline Board Genesee County Hearing Panel #1.

1) Suspension - thirty (30) days; 2) Effective January 28, 1995. Respondent failed to timely answer the Formal Complaints but appeared at the hearing held in Flint on June 7, 1994. Respondent's default was entered, and the panel determined that the defaults established the allegations of the Formal Complaints.

Respondent was retained to represent a client in a worker's disability claim, but failed to keep his client informed of the status of her matter; failed to answer his client's inquiries; failed to appear for a hearing, resulting in the entry of an order of dismissal; failed to appeal the dismissal; failed to prosecute a second petition for hearing, resulting in its dismissal; and failed to answer the Request for Investigation.

Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A)and(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 3.2; 8.1(b); and 8.4(a)and(c).

The panel ordered that respondent be suspended from the practice of law for thirty days. Costs were assessed in the amount of $363.52.

Respondent filed a petition for review, which was dismissed by the Attorney Discipline Board on January 6, 1995 for respondent's failure to file a brief in support of petition for review.
