NOTICE OF SUSPENSION Case No. 94-202-JC David M. Foster, P-30041, Birmingham, Michigan, by the Attorney Discipline Board affirming Tri-County Hearing Panel #58's Order of Suspension.
1) Suspension - thirty (30) months; 2) Effective October 31, 1994. On October 31, 1994, respondent was convicted in the United States District Court for the Eastern District of Michigan, by guilty plea, of Causing the Failure to File a Currency Transaction, in violation of 31 USC 5324(1). In accordance with MCR 9.120(B) (1), respondent was automatically suspended from the practice of law in Michigan effective October 31, 1994, the date of the felony conviction. The Grievance Administrator filed a Judgment of Conviction with the Attorney Discipline Board. The Board entered an order directing the respondent to show cause why a final order of discipline should not be entered.
On July 21, 1995, the panel entered an order suspending respondent from the practice of law in Michigan for thirty months effective October 31, 1994, the effective date of the automatic interim suspension. The Grievance Administrator and the respondent each filed a petition for review. In an order entered December 18, 1995, the Attorney Discipline Board affirmed the hearing panel order of suspension.
Costs were assessed in the amount of $498.82.
