1) Revocation; 2) Effective November 4, 1994. The respondent appeared personally before the hearing panel and entered a plea of no contest to the allegations of professional conduct contained in a forty-count complaint which charged that the respondent had neglected legal matters entrusted to him, failed to communicate adequately with clients, misrepresented the status of cases to clients, misappropriated funds entrusted to him by a client or third party and failed to answer Requests for Investigation. Respondent's conduct was alleged to be in violation of MCR 9.104(1-4,7); MCR 9.113(A); MCR 9.113(B)(2) and the Michigan Rules of Professional Conduct 1.1(c), 1.3, 1.4, 1.15, 1.16(d), 3.2, 4.1 and 8.4(a-c).
Following a separate hearing on discipline, the panel concluded that, notwithstanding the respondent's personal problems raised in mitigation, the respondent's wide-spread pattern of misconduct which commenced shortly after his admission to the practice of law in 1990 warranted revocation. The respondent was ordered to make restitution to two clients in the total amount of $4000 and to pay costs in the amount $776.39.
