1) Reprimand With Conditions; 2) Effective October 20, 1994. At the commencement of the public hearing before a hearing panel, the respondent withdrew her answer to the formal complaint and offered a plea of no contest to the charges that she was retained in February 1989 to institute bankruptcy proceedings on behalf of a client but failed to institute those proceedings, failed to keep her client reasonably informed regarding the status of the matter and failed to timely refund the unearned fees which had been paid. The panel accepted the respondent's plea and determined that respondent's conduct constituted violations of MCR 9.104(1-4) and Michigan Rules of Professional Conduct 1.3(c); 1.3; 1.4; 1.15(b); 1.16(d); 3.2 and 8.4(a-c).
The hearing panel conducted a separate hearing on discipline and considered the terms and conditions imposed in connection with a prior order of discipline suspending her license for a period of thirty days effective September 14, 1993 in Matter of June A Porter, 92-136-GA. The panel concluded that the respondent was complying in all respects with those conditions and that those conditions should be continued for one year. Costs were assessed in the amount of $285.25.
