AMENDED NOTICE OF SUSPENSION

Case No. 92-108-GA Timothy S. Crawford, P-35730, Detroit, Michigan, by the Attorney Discipline Board affirming a hearing panel order of suspension.

1) Suspension - 120 days; 2) Effective August 15, 1994. Respondent was retained to represent two defendants, each charged with murder in the first degree and felony firearm arising out of the same incident. Tri-County Hearing Panel #33 found that respondent accepted the dual representation although it was reasonably foreseeable that zealous representation of one defendant could adversely impact on the interests of the other defendant; failed to advise one defendant that zealous representation of that client may not be in the best interests of the other client; and, the dual representation was prejudicial and damaging to the extent that he could not have effectively and zealously represented both defendants since their defenses were potentially antagonistic.

Respondent's conduct was found to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.7(a)and(b). On October 15, 1993, the panel entered its order of suspension.

Respondent filed a petition for review. On January 14, 1994, the Attorney Discipline Board entered its order affirming the hearing panel order of suspension. Respondent filed an application for leave to appeal, which was denied by the Michigan Supreme Court in an order issued June 28, 1994.

Respondent filed a Motion to Stay Suspension. On July 26, 1994, the Board entered an Order Granting Motion to Extend Stay of Discipline. The suspension is now deemed to be effective August 15, 1994.

Costs were assessed in the amount of $2499.57.
