NOTICE OF SUSPENSION Case Nos. 99-090-GA

Henry W. Schober, P-30268, Philadelphia, Pennsylvania, by Attorney Discipline Board Ingham County Hearing Panel #2.

1) Suspension - 4 Years; 2) Effective August 31, 1994 Respondent was convicted on December 9, 1998 of felony possession with intent to deliver less than 50 grams of the controlled substance cocaine, in violation of MCL 333.74012(A)(4). In accordance with MCR 9.120(B)(3), the Attorney Discipline Board assigned this matter to a hearing panel and ordered respondent to show cause why a final order of discipline should not be entered.

The hearing panel found that respondent has not resided in the state of Michigan since December 1993 and has not engaged in the practice of law in Michigan since August 1994. The panel noted that respondent=s guilty plea was based upon an event which occurred on January 1, 1992 and the panel considered respondent=s voluntary efforts to cease the use of controlled substances prior to his arrest, his continued recovery, his compliance with the terms of his probation, his previously unblemished record as an attorney and substantial pro bono service as an attorney in the state of Pennsylvania.

The panel ordered that respondent be suspended from the practice of law in Michigan for a period of four years but that it should be retroactive to August 31, 1994. The panel further ordered that respondent should tender his resignation as a member of the State Bar of Michigan within 30 days of the effective date of the suspension order. Costs were assessed in the amount of $542.50.
