NOTICE OF REPRIMAND Case Nos. 92-191-GA; 92-212-FA Perry T. Christy, P-11874, Dearborn, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #5.

1) Reprimand; 2) Effective July 22, 1994. Respondent was retained to represent the defendant in a divorce action. The panel found that respondent failed to appear or to timely appear for a final conference which resulted in the entry of a default against his client; and, following the entry of a judgment of divorce, he failed to take appropriate steps to have the judgment set aside. Respondent was personally served with a subpoena duces tecum that required his appearance at the offices of the Attorney Grievance Commission with "All files, records, documents, correspondence, memorandums or other writings" regarding the above-described divorce action and "to give testimony UNDER OATH." The panel found that respondent failed to appear pursuant to that subpoena. The panel also found that respondent failed to timely answer Formal Complaint 92-191-GA.

Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 3.2; and 8.4(a)and(c).

Respondent filed a petition for review, which was dismissed on July 1, 1994 for his failure to file the required brief in support of petition for review.

Costs were assessed in the amount of $941.83.
