NOTICE OF SUSPENSION (By Consent)

Case No. 93-274-GA Allan A. Saroki, P-37441, Farmington Hills, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #103.

1) Suspension - thirty (30) days; 2) Effective May 25, 1994. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5), which was approved by the hearing panel and the Attorney Grievance Commission.

Respondent accepted the representation of the plaintiffs in claims arising from a dog bite incident and filed an action on his clients' behalf. The case was mediated for $3500. The plaintiffs accepted the mediation award but it was rejected by the defendant. Subsequent to the mediation, the case was remanded to the district court for further proceedings.

Respondent pled nolo contendere to allegations that he failed to advise his clients of a settlement offer from the defendant; agreed to settle the case for $600 without his clients' knowledge or consent; and executed a stipulation to dismiss the case with prejudice without his clients' knowledge or consent.

Respondent's conduct was alleged to be in violation of MCR 9.104(1)-(4) and Michigan Rules of Professional Conduct 1.1(c); 1.4(a)and(b); and 8.4(a)-(c).

Costs were assessed in the amount of $55.25.
