NOTICE OF SUSPENSION Case Nos. 92-230-GA; 93-257-FA Frank L. Gillespie, IV, P-37513, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #7.

1) Suspension - one (1) year; 2) Effective April 1, 1994. Respondent failed to answer the formal complaint but appeared at the hearings held in Detroit on December 15, 1993 and January 27, 1994. Respondent's default was entered, and the panel determined that the default established the allegations of the formal complaint.

Respondent agreed to represent the defendants in a civil action. A default was entered for the defendants' failure to answer. Respondent failed to answer interrogatories; failed to file a witness list and/or exhibit list; failed to respond to the motion for default judgment or to appear at the hearing; failed to adequately communicate with his clients; and knowingly made false statements to opposing counsel.

Respondent's conduct was found to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 3.2; 3.3(a)(1); 3.5(c); and 8.4(a)-(c).

Costs were assessed in the amount of $305.08. NOTE: Respondent's license to practice law in Michigan has been suspended continuously since April 28, 1993.
