NOTICE OF REVOCATION AND RESTITUTION Case Nos. 94-39-GA; 94-68-FA Richard G. Parchoc, P-34727, Dearborn, Michigan, by the Attorney Discipline Board increasing a hearing panel order of suspension for three years and one day.

1) Revocation; 2) Effective April 22, 1994. Respondent failed to answer the Formal Complaint and failed to appear at the hearing held in Southfield on April 22, 1994. Respondent's default was entered, and the panel determined that the default established the allegations of the Formal Complaint.

Respondent was retained to file a lawsuit, but failed to take any action in the matter; failed to respond to his client's inquiries or to keep her reasonably informed; failed to refund the unearned $2,250 retainer; knowingly made false representations to his client; failed to inform his client of his suspension from the practice of law; continued to hold himself out as an attorney after the effective date of his suspension (June 9, 1993); and failed to answer the Request for Investigation.

Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4),(7)and(9); MCR 9.113(A)and(B)(2); MCR 9.119(A)and(C); MCL 600.916; MSA 27A.916; and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4; 1.5(a); 1.15(b); 1.16(d); 3.2; 5.5(a); 8.1(b); and 8.4(a)-(c).

The panel noted respondent's prior discipline, which consists of three suspensions, and ordered that his license to practice law be suspended for three years and one day effective April 22, 1994, and that he make restitution in the amount of $2,500.

The Grievance Administrator filed a petition for review. In an order and opinion issued December 2, 1994, the Attorney Discipline Board increased discipline to revocation of respondent's license. Costs were assessed in the total amount of $296.07.

NOTE: Respondent has been suspended from the practice law in Michigan continuously since June 9, 1993.
