1) Suspension - one (1) year; 2) Effective April 16, 1994. Respondent became the co-trustee of a trust established for a deceased long-time client. A bank account for the trust was established, of which respondent was a co-signator.
Respondent admitted that he caused to be issued and negotiated, without the knowledge of the co-trustee or the other beneficiaries, two trust account checks totalling $28,000.00, made payable to himself, constituting misappropriation. The parties stipulated that respondent reimbursed the trust for the misappropriated funds.
Respondent's conduct was found to be in violation of MCR 9.104(1)-(4); and Michigan Rules of Professional Conduct 1.4; 1.15; and 8.4(a)-(c).
The panel ordered that respondent be suspended from the practice of law for one year subject to continued treatment for depression. Costs were assessed in the amount of $256.50.
