NOTICE OF INCREASED SUSPENSION Case No. 93-261-GA Jack Carpenter, P-11640, Petoskey, Michigan, by the Attorney Discipline Board increasing Grand Traverse County Hearing Panel's Order of Suspension for seven (7) months.

1) Suspension - Five (5) Years; 2) Effective March 23, 1994. Respondent admitted the allegations in the Formal Complaint that, for a period of nearly two years, he engaged in conduct which constituted violations of MCR 9.104(1)-(5); the Michigan Rules of Professional Conduct, 8.4(a)-(c); and MCL 750.520c [Criminal Sexual Conduct, Second Degree].

The panel ordered that respondent's license to practice law be suspended for seven months. The panel took into consideration the mitigating factors of respondent's exemplary record of providing legal services for his clients; voluntary reporting of his criminal behavior; payment of sums to or for the benefit of the victim and her family; counseling and treatment for himself; and that the offenses were apparently unrelated to his practice of law.

The Grievance Administrator filed a petition for review. On review, the Attorney Discipline Board, by majority, increased discipline to a five-year suspension.

Respondent filed an application for leave to appeal, which was denied by the Michigan Supreme Court in an order entered September 23, 1997.

Costs were assessed in the total amount of $793.81.
