NOTICE OF SUSPENSION Case Nos. 93-251-GA; 93-286-FA Alexander R. Bensky, P-25084, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #25.

1) Suspension - one (1) year; 2) Effective March 5, 1994. Respondent failed to answer the formal complaints and failed to appear at the hearing held in Detroit on January 17, 1994. Respondent's defaults were entered, and the panel determined that the defaults established the allegations of the formal complaints.

Respondent was appointed to represent sixteen defendants in criminal appellate proceedings, but failed to file timely appellate briefs in two cases; failed to seek any post-conviction relief in fourteen cases; failed to keep all sixteen defendants reasonably informed concerning the status of the matters; and failed to answer the request for investigation.

Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1)-(4)and(7); MCR 9.113(A); MCR 9.113(B)(2); and the Michigan Rules of Professional Conduct, 1.1(a)-(c); 1.3; 1.4; 3.2; 3.4(c); 8.1(b); and 8.4(a)and(c).

Costs were assessed in the amount of $138.29. NOTE: Respondent's license to practice law in Michigan has been suspended continuously since October 30, 1993.
