NOTICE OF RECIPROCAL SUSPENSION Case No. 94-49-RD Sandra S. Schultz, P-30269, Carrollton, Michigan, by the Attorney Discipline Board affirming Saginaw County Hearing Panel's Order of Suspension and modifying the effective date.
1) Suspension - two (2) years; 2) Effective January 10, 1994. Respondent's license to practice law in Wisconsin was suspended for two years by the Wisconsin Supreme Court effective January 10, 1994. The Wisconsin court found that respondent neglected a medical malpractice claim; failed to keep her client informed of the status of the claim; misrepresented to her client that the claim remained pending after the action had been dismissed and the appeal of the dismissal had also been dismissed; misrepresented to the circuit court her ability to obtain an expert witness; and failed to comply with the circuit court's scheduling order, an order of the appellate court and three orders of the referee in the Wisconsin disciplinary proceeding.
In accordance with MCR 9.104, the panel found that there was adequate proof of an adjudication of misconduct in disciplinary proceedings against respondent by the Wisconsin Supreme Court; that respondent had been offered due process in the Wisconsin proceedings; and that it would not be inappropriate to impose identical discipline in Michigan.
Respondent filed a petition for review. In an order issued August 23, 1995, the Attorney Discipline Board affirmed the hearing panel order of suspension and modified the effective date to January 10, 1994, to run concurrent with the Wisconsin suspension. Costs were assessed in the total amount of $398.79.
NOTE: Respondent's license to practice law in Michigan has been suspended continuously since September 14, 1991.
P.S. Respondent filed an application for leave to appeal, which was denied by the Michigan Supreme Court in an order entered May 31, 1996.
